Over the course of the last few months there have been a number of interesting cases concerning employment law. There was a decision out of the Nova Scotia Court of Appeal that I understand is now headed to the Supreme Court of Canada relating to recoverability of damages arising during the period of notice, a case dealing with incorporation of terms into the contract of employment, two seemingly contradictory decisions with respect to aggravated damages and a decision regarding duty of care of an employer in allowing an ill employee to drive.
